Terms of Service

These Terms of Service ("Terms") govern your access to and use of EmpireOS, a project and operations management platform operated by Ben Findlay ("we", "us", "our"). By creating an account or using EmpireOS you agree to these Terms. If you do not agree, do not use the service.

1. What EmpireOS Is

EmpireOS is a software-as-a-service platform that helps independent developers and small teams track their software projects, monitor deployments and incidents, manage ideas, track revenue, and analyze their technical stack. It includes integrations with third-party services such as GitHub, Vercel, Stripe, Sentry, and Better Stack.

We reserve the right to modify, suspend, or discontinue any feature or the service as a whole at any time. We will provide reasonable notice where practical.

2. Account Registration

You must create an account to use EmpireOS. You are responsible for keeping your credentials secure and for all activity that occurs under your account. You must be at least 16 years old to create an account. You may not create accounts on behalf of others without their consent.

You agree to provide accurate information during registration and to update it as needed to keep it current. Accounts with false information may be suspended.

3. Acceptable Use

You agree not to use EmpireOS to:

  • Violate any applicable law or regulation.
  • Upload, transmit, or store content that is illegal, harmful, or infringing.
  • Reverse-engineer, decompile, or attempt to extract the source code of the platform.
  • Attempt to gain unauthorized access to any part of the service or its infrastructure.
  • Conduct automated scraping, crawling, or data harvesting beyond what the API permits.
  • Use the platform to build a competing product without our express written consent.
  • Interfere with the service's availability or burden it with disproportionate load.
  • Store sensitive personal data of your users inside project notes or free-text fields.

We reserve the right to suspend or terminate accounts that violate these rules.

4. Plans and Billing

EmpireOS is currently available on a free plan and paid plans. Paid plan pricing is listed in the application. Subscriptions are billed in advance on a monthly or annual basis via Stripe. All fees are non-refundable except where required by applicable law or at our sole discretion.

If you fail to pay, we may downgrade or suspend your account after providing notice. We will notify you before any pricing changes take effect.

5. Your Data and Content

You retain ownership of all data you upload or create inside EmpireOS — project records, ideas, notes, and similar content. By using the service you grant us a limited, non-exclusive license to store and process that data solely for the purpose of providing the service to you.

We do not claim ownership of your data and will not use it for any purpose beyond operating and improving EmpireOS. You can export or delete your data at any time from Settings > Account.

6. Integrations and Third-Party Services

When you connect a third-party integration (e.g. GitHub, Stripe), you authorize us to access that service on your behalf using the credentials you provide. You are responsible for ensuring you have the right to grant that access. We are not responsible for data accuracy, availability, or the terms of those third-party services.

7. Intellectual Property

EmpireOS, its logo, design, and underlying software are owned by us and protected by intellectual property law. Nothing in these Terms transfers any intellectual property rights to you. You may not use our trademarks or brand without written permission.

8. Account Termination

You may close your account at any time from Settings > Account > Delete Account. Closure anonymizes your personal data within 30 days as described in our Privacy Policy.

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if required by law. Where practical we will provide notice and an opportunity to appeal.

9. Disclaimers

EmpireOS is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose or uninterrupted availability. We do not guarantee that the service will be error-free or that data synced from third-party integrations will be accurate or complete.

Use of the service is at your own risk. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

10. Limitation of Liability

To the maximum extent permitted by applicable law, our total aggregate liability to you for any claim arising out of or related to the service is limited to the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50. We are not liable for indirect, incidental, consequential, or punitive damages, loss of data, or loss of profits.

11. Governing Law

These Terms are governed by the laws of the jurisdiction in which the operator is incorporated, without regard to conflict-of-law principles. Any disputes shall be resolved exclusively in the courts of that jurisdiction, and you consent to personal jurisdiction there.

If you are located in the EU, nothing in these Terms limits your rights under EU consumer protection or data protection law.

12. Changes to These Terms

We may update these Terms from time to time. We will update the "Last updated" date at the top of this page and, for material changes, notify you by email at least 14 days before they take effect. Continued use of the service after the effective date constitutes acceptance.
